Trust Administration

A properly drafted living trust can be a powerful tool.  After all, it can avoid probate, which is an expensive, lengthy and public process that takes place in open court.  Ultimately, a properly drafted living trust can save a family quite a bit of money.

But having a living trust doesn't mean there's nothing to do after someone dies.  That often comes as a surprise to surviving spouses and beneficiaries.

A trustee of a living trust has a duty to administer the trust. In fact, the trustee can be personally liable for failing to do it incorrectly.

That's why a successor trustee usually hires a skilled attorney to represent them in carrying out their obligations.  This can mean the difference between a smooth transition of assets from the deceased person to their heirs and a fiasco.
